Welcome to Use Winston AI (“Winston,” “we,” “our,” or “us”). These Terms of Service (“Terms”) govern your access to and use of the Winston website, mobile applications, and related services (collectively, the “Services”), operated by Use Winston AI, Inc., a Delaware corporation.
By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.
1. Eligibility

2. What Winston Is (and Is Not)
Winston is a personal operating system designed to help users:

Organize thoughts with AI
Set and track goals
Build habits through daily check-ins
Gain clarity and motivation over time
No Financial, Legal, or Medical Advice
Winston does not provide investment, financial, legal, or medical advice.
Any insights, summaries, or suggestions generated by Winston are for informational and educational purposes onlyand should not be relied upon as professional advice. You are solely responsible for your decisions and actions.
3. Account Registration
To access certain features, you may need to create an account. You agree to:
Provide accurate and complete information
Maintain the security of your credentials
Notify us immediately of unauthorized access
You are responsible for all activity that occurs under your account.
4. User Content
You retain ownership of all content you submit, including journal entries, reflections, and uploads (“User Content”).
By using the Services, you grant Use Winston AI, Inc. a limited, non-exclusive, royalty-free license to process and use your content solely to operate, maintain, and improve the Services, including AI-powered features.
We do not sell your personal data.
5. AI Features
Winston uses artificial intelligence to analyze and summarize user input.
You acknowledge and agree that:
AI-generated outputs may be inaccurate, incomplete, or misleading
AI responses should not be treated as factual or authoritative
You are responsible for how you interpret and use AI-generated content
6. Acceptable Use
You agree not to:
Use the Services for unlawful purposes
Attempt to reverse engineer or exploit the platform
Upload harmful, abusive, or malicious content
Interfere with system security or performance
We reserve the right to suspend or terminate access for violations of these Terms.
7. Subscriptions & Payments
Some features of Winston may require a paid subscription.
Apple App Store Subscriptions
If you purchase a subscription through the Apple App Store:
Payment will be charged to your Apple ID
Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period
You can manage or cancel your subscription through your Apple App Store account settings
All fees are disclosed prior to purchase. Payments are non-refundable except as required by law.
8. Intellectual Property
All content, software, design, trademarks, and branding associated with Winston (excluding User Content) are owned by Use Winston AI, Inc. and protected by applicable intellectual property laws.
You may not copy, modify, distribute, or exploit our materials without written permission.
9. Termination
You may stop using the Services at any time.
We may suspend or terminate your access if:
You violate these Terms
Required by law
Necessary to protect Winston, its users, or operations
10. Disclaimers
The Services are provided “as is” and “as available.”
We make no warranties regarding accuracy, reliability, availability, or fitness for a particular purpose. Use of Winston is at your own risk.

13. Apple App Store Disclaimer
You acknowledge that these Terms are between you and Use Winston AI, Inc., not Apple Inc.
Apple is not responsible for the Services or their content and has no obligation to provide maintenance or support. Apple is not responsible for any claims, losses, or liabilities arising from the app or its use.
14. Privacy Policy
Your use of the Services is also governed by our Privacy Policy, which explains how we collect, use, and protect your information.
15. Governing Law
These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles.
